Kentucky Launches First Medical Cannabis Safety Facility as Program Momentum Grows

Kentucky’s long-aware medical cannabis program is finally taking root. 


On May 29, 2025, Governor Andy Beshear announced that patients who received a medical cannabis card in 2025 won’t have to pay the $25 renewal fee in 2026, offering relief to thousands who are still waiting for dispensaries to open. That same week, the state broke ground on its first cannabis safety compliance facility, marking a major turning point in how Kentucky is rolling out its program.


The facility, backed by a $1 million investment from State38LLC, will employ about a dozen people and be the first of seven planned labs dedicated to testing and verifying cannabis product safety across the state. It’s a big moment — and if you’re a dispensary owner, operator, or cannabis employer, it’s time to pay attention. 

History of Kentucky’s Marijuana Legalization 

On March 31, 2023, Governor Beshear signed legislation to legalize medical cannabis, with an official start date of January 1, 2025. That gave the state a solid runway to build out regulations, set up a licensing system, and prepare infrastructure before day one. 


Since then, here’s what has happened:

  • July 1, 2024: Business license applications opened
  • December 2024: Medical providers started issuing patient certifications
  • May 2025: Over 10,000 medical cannabis cards have been issued
  • A statewide dispensary map has launched
  • Construction has started on safety compliance labs


However, not all dispensaries are open yet. Some are up and running, some are in development, and many patients are still waiting. The $25 renewal fee waiver for 2026 makes sure early adopters aren’t paying for a card they can’t actually use.

Medical Marijuana Eligibility and Accessibility in Kentucky

While medical marijuana is now accessible in Kentucky, recreational (adult-use) cannabis is still illegal. This means that cultivating, manufacturing, possessing, and using cannabis is prohibited in the state.


To qualify for a medical marijuana card, patients must be Kentucky residents and 18 years of age or older. Younger patients must have a registered caregiver. Other requirements include not having a disqualifying felony and receiving a certification from a medical provider for a qualifying condition.
